Bus 415 How does tort law impact consumers and businesses - Essay Example Despite the creation of tort law, as we know it today, there are many individuals in society who believe that businesses are unfairly targeted by malicious civil cases by consumers looking for a quick (and unjustified) buck. The outcomes of tort cases can have significant impacts on the average consumer, as what might be interpreted as frivolous lawsuit payouts are often passed back to the consumer in the form of retail price increases or the addition of various service fees. Why is this done? Businesses who are forced, by an active judgment, to pay out large sums of money to consumers for any variety of wrongdoing usually attempt to recapture these lost revenues by adding additional costs to the consumer. However, in many instances, it would appear that the consumers who bring up a lawsuit against a business actually do have a very valid case by which to provide evidence that a wrongdoing has occurred. First, it has been said that the only real responsibility of todays American businesses are to earn profit and satisfy the stakeholder and shareholder (Nickels, McHugh & McHugh, 2005). Under this assumption, a business which is unable to provide ample profit due to excessive tort payouts, would obviously not be providing this social responsibility to its investors. How, then, does the business maintain profitability when its revenues are paid out to alleged greedy consumers looking to make a fast buck? Most interesting is the well-known case of the old lady who sued McDonalds for burns received by a hot cup of coffee. In this case, the woman received burns to 6% of her body after spilling the contents of her styrofoam cup on her inner thighs and genital regions. After much professional scrutiny, it was determined that McDonalds did not carry ample warning information on their coffee to-go cups and that they had further experienced over 700 complaints from other

Jeffery Dahmer Essay -- essays research papers

The serial killer that I chose to profile is Jeffery Dahmer. Dahmer brings both horrifying, yet amazing qualities to the table in the respect that he terrorized people, not only those that were his victims, but also people that lived both near and those around the country. Section I: Overview - Jeffery Dahmer - Born on May 21, 1960, at Evangelical Hospital in Milwaukee, Wisconsin - Jeffery Dahmer was found beaten by fellow inmates on the morning of November 28, 1994, as was pronounced dead at 9:11 a.m. - Was given life imprisonment on 15 counts of murder committed in Wisconsin and one committed in Ohio, for which he was tried separately. He was sentenced to fifteen consecutive life terms for a total of 957 years in prison. - Jeffery Dahmer was always seen as very shy and isolated at an early age. Dahmer had fantasies about killing men and having sex with the corpses. Despite the early tendencies of his childhood, Dahmer didn’t act on any of these sexual fantasies until after he had graduated from highschool in June of 1978. Dahmer picked up a hitchhiker by the name of Steven Hicks, and eventually Hicks would be the first victim of Dahmer. Dahmer then enrolled at Ohio State University, only to flunk out within one semester. Next, Dahmer joined the army at the end of 1978, but was discharged for alcoholism and went to live in Florida before returning to Ohio. Dahmer was then arrested in October of 1981 for drunken and disorderly conduct, so his father sent him to live with his grandmother in West Allis, Wisconsin. Dahmer had a couple of sexual legal incidents, then kept cool for about four years. In 1987, Dahmer killed his second victim, Steven Toumi, and would go on a ravenous murder spree after that. - Victims were mainly homosexual men, mostly African-American - Dahmer was active from June 1978 to July 22, 1991 Section II: Childhood Dahmer was born on May 21, 1960, to Lionel and Joyce Dahmer. Dahmer was wanted and loved despite Joyce’s problems in pregnancy. Dahmer was a normal, healthy child that showed no signs of mental problems. When Dahmer was four, Lionel was sweeping under the house for small animals that had been killed by civets. As Lionel gathered the bones Dahmer was fascinated with the bones of the dead animals. When Dahmer was six, he suffered from a double hernia and needed surgery to correct the problem. I think that Dahmer had a very big problem with the isolation that he faced at an early age in life. Dahmer saw that his parents were never happy, and maybe that’s why he had homosexual tendencies. He not only collected the bodies of dead animals at an early age, but also he had fantasies about killing people and then having sex with the corpses. Diet and Exercise Hanse Bidon COM/155 – University Composition and Communication I March 14, 2013 Cynthia Jones Diet and exercise Today, my physician informed me that I was significantly overweight and that my health was in jeopardy. Immediately, I stated dieting which included fruits and vegetables while abstaining from starches and sodas. In the course of two weeks, I noticed that I dropped 20 pounds as a result of a result of implementing this diet however I noticed sagging of the skin in certain areas. My weight loss halted and it appeared that I hit a weight plateau.In an attempt to resolve these issues, I started an exercise regimen which included cardio and free weights. Shortly after, I began to see weight loss however my energy and endurance began to slowly dwindle. After consulting with my physician, she encouraged me to combine both diet and exercise, which resulted in me managing my weight, tightening my skin, an increasing my endurance and energy. This process has taught me that weight loss can be achieved by diet and exercise individually, however when the two are combined, it can result in weight loss and weight management.There are advantages and disadvantages when using diet and exercise individually alone when trying to lose weight. These advantages and disadvantages individually can have adverse and favorable effects on your mental health, physical health and wellness. Dieting can be jarring for some people the idea of giving up certain foods to attain weight loss, can be very challenging. For so many people, Dieting is defined as the restraining of certain foods and practices that result in a desired state of mind and physical wellness.This desired state of mind and physical wellness could result in advantages such as weight loss, reduction of chronic diseases, and improved self-esteem. Weight loss as it relates to the advantages of dieting reflects the shedding of unwanted, unhealthy weight which ultimately is how we previously saw o urselves. Once the weight has been shed, we begin to see ourselves through new eyes with confidence and self-worth, which boosts your self – esteem. Not only do you improve yourself image, you improve your health as well.With weight loss, you reduce your chances of developing any chronic diseases such as high blood pressure, high cholesterol and some diseases that can be associated with heart disease. Although, some success can be achieved from dieting alone, it also has some disadvantages. Dieting alone for the sake of weight loss has some disadvantages such as fatigue and depression. One of the disadvantages of dieting alone is fatigue; this may occur when the body is trying to adjust to the change in eating habits and the lack of nutrients. You may experience dizziness and you’re tired all the time.These are symptoms of fatigue. A sudden change in eating habits because of a diagnosis can result in a person becoming depression, such as high blood pressure. In additio n to dieting, exercise is another method that is used to lose and manage weight. Exercise, just like dieting has significant advantages if deployed correctly. Some of these advantages involve physical and mental advantages. The physical advantages as it relates to exercises include weight loss, lower blood pressure, and the reduction of severe diseases such as diabetes, and life threatening cancers such as prostate and colon cancers.Another advantage to consistent exercise is the mental advantages; the act of exercising consistently releases a chemical in your body known as endorphins, which ultimately are responsible for stress and anxiety reduction. The endorphins in your body which are released when you exercise allow you to sleep comfortably at night and also work to increase your self-esteem allowing you to feel better about yourself and the progress you’re making. However, over working your muscles can result in more harm than good.Unfortunately, there are noticeable di sadvantages that come with exercise or the lack of proper exercise. These disadvantages come in the forms of improper training or preparation for exercise and the heightened possibility of injury because of lack of preparation. Over Utilizing the use your muscles can cause soreness because of microscopic tears in the muscle tissue. This process is normal however not implementing the right form or cardiovascular training can result in an inevitable state of injury, which can be a direct reflection of an improper training regimen.Overtraining can result in a number of issues such as insufficient amount of sleep, a compromised immune system, energy deficiency, and muscle and joint pain. While separately, exercise and diet provide various advantages and disadvantages, the two when implemented together provided various benefits. These benefits consist of healthier cardiovascular system, stronger bones, and effective weight loss. Any form of walking, swimming, jogging while implementing a low fat diet is a good way to maintain a good cardiovascular system.Another benefit of diet and exercise is the prevention of osteoporosis by incorporating foods rich in vitamin D, calcium such as fish, cheese, yogurt, low fat milk and with strength training. In addition maximum weight loss and management, reduction of the risk of chronic diseases and an improvement in mental health can be achieved when diet and exercise are implemented effectively. As I learned from my own struggles with weight lost, there are no quick fixes.Dieting without exercise will ultimately result in very little weight loss. The disadvantages that exist when you choose to lose weight by dieting only should be considered before eliminating exercise from your weight lost plan. Exercise without dieting will result in some weight loss as well and will help to improve your health, however, the disadvantages of just exercising should be consider before excluding dieting from your weight loss plan.Combine both di et and exercise will allow you to achieve maximum weight loss, weight management, and improve health, can contribute to your mental health in a positive manner, and increased strength in bones. Although there are many diet ads that suggest quick ways to lose weight such as shaking a substance on your food to curve your appetite, drinking shakes, eating cookies, some plans suggesting that you don’t have to change the way you eat to lose weight, and some insisting that just taking a pill, and the weight will fall off. None will replace both exercise and a well balance diet

Sounds simple enough to some, but for many people taking the first step can be quite difficult. In other words, putting off something intentionally that should be done is called procrastinating (Merriam-Webster, 2010). There are lots of reasons that people can’t take that first step for such as having a busy schedule, stress, afraid of failure or wanting complete perfection; because of this, people tend to wait until the last minute to do things, lye to themselves, do other things instead of what needs to be done and avoid making decisions. Actually, waiting until the last minute gives some people just enough pressure to complete their task or time to refresh their minds. Therefore, procrastinating can be a positive thing for some, but for others it can be a barrier that hinders one from accomplishing the simplest-everyday tasks to more long term goals. So for those people that consider procrastination a problem, once you figure out how and why you procrastinate, then you find a solution for your problem. â€Å"There are many ways to avoid success in life, but the most sure-fire just might be procrastination. Procrastinators sabotage themselves. They put obstacles in their own path. They actually choose paths that hurt their performance† (Staff, 2005). Thus, procrastination can be a problem for many people. Waiting until the last minute to do things or not making decisions can cause detrimental side-effects on ones emotional and physical state. Subsequently, it can be stressful and cause you to feel hopeless or depressed which often delays or stops people from achieving their ultimate goals or becoming successful, but it is possible to prevail over it. In order to overcome procrastination, first you need to gather a few things to get started (you may need more or less as youbegin to learn more about yourself): a notepad and pen, a calendar or some sort of date book (both can also be done on your personal computer), some rewards for yourself and a new positive attitude. Next, you need to determine why you are procrastinating. Harold Taylor lists several reasons why we procrastinate and how to defeat them. For example: Sometimes we figure that tasks are more unpleasant than they truly are; so, â€Å"complete these tasks first, schedule them for early in the day, and give yourself a reward for doing them. † Also, break complex projects into smaller ones, and if you are afraid of failure, remind yourself of how good you’ll feel when you finish. Moreover, if perfectionism and making decisions are your struggle, determine a time to make decisions and set deadlines. Remember that even the simplest things can cause someone to procrastinate like a lack of interest or distractions; free your-self from interruption and clutter (Taylor). In addition, use your calendar and date book to make appointments and set your deadlines; write down everything from daily tasksto your long term goals. Finally, measure your achievements and with any objective you conquer in procrastination reward yourself. Furthermore, people can procrastinate in any and everything they do whether it isacademically, in the workforce or just daily living. â€Å"Based on some figures, it is estimated that as much as 95 % of the people are prone to procrastination. Amongst them, 20 % of them are chronic procrastinators. These people have an increasing chance of losing their jobs, have financial problems and have serious problems with their relationship with others† (Hobbs, 2008). What’s more, with academic procrastination, students may not complete work or meet deadlines, and as result, they may fail and not graduate. Also, workforce procrastination can mean not completing assignments at work, not applying for a promotion, or not looking for a better job; so procrastination in the workforce can not only lead to trouble there, but also difficulties financially and in your relationship. At some moment in everyone’s life we may procrastinate in our daily living like waiting until the next day to clean up, but as long as it does not effect of livesnegatively we should be able to overcome it. However, if it does, just follow the instructions above and one should be fine. So if you are a procrastinator, remember that you are not in this alone; as you can see, 95% of us procrastinate in some way. As we mentioned above, consider what type of procrastinator you are, how you procrastinate and what motivates you to reach beyond and you should be able to overcome it. Think about what makes you tick. Besides, it takes a lot of discipline to break this pattern. Consider what inspires you to advance, move ahead and be successful. Thus, use your pen, paper, planner, gather your rewards and develop a positive attitude and you will be on your way to coping with procrastination. In conclusion, procrastination can be positive or negative, but as you can see, it clearly affects people’s lives. For plenty of people it does not help them; it actually hurts them. However, one can rise above it by simply remembering that you are a procrastinator and how to fix it. Do not wait until the last minute to do things or avoid making decisions because these are all signs of procrastination.
